01 Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “user”), and ForEV Electric Vehicle Charging Stations (“we,” “us,” “our,” or “ForEV”), concerning your access to and use of the ForEV mobile application (the “App”) and the electric vehicle charging services across the ForEV Public Charging Network in the United Arab Emirates (the “Services”).

You agree that by accessing the App and using the Services, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the App and Services, and you must discontinue use immediately.

ForEV is a Charge Point Operator (CPO) providing electric vehicle charging services across the United Arab Emirates. The payment processor for all transactions is Network International.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms and Conditions. It is your responsibility to periodically review these Terms and Conditions to stay informed of updates.

02 Eligibility and User Representations

By using the App and Services, you represent and warrant that:

All registration information you submit will be true, accurate, current, and complete.
You will maintain the accuracy of such information and promptly update such registration information as necessary.
You have the legal capacity, and you agree to comply with these Terms and Conditions.
Your use of the App and Services will not violate any applicable law or regulation in the UAE.

03 Eligibility and User Representations

“App”: The ForEV mobile application.
“Charging Point”: The physical equipment used to charge an electric vehicle on the ForEV network.
“Customer” / “User”: Any registered user or visitor who uses the App and Services.
“ForEV”: The Charge Point Operator providing the EV charging services.
“Services”: The electric vehicle charging services provided by ForEV.

04 Customer Obligations and Proper Use

4.1. Dedicated Use of Parking Bays: Parking bays and spaces where ForEV public charging equipment is installed are strictly reserved for electric vehicles (EVs) being actively charged. The occupation of these bays by vehicles other than EVs or by EVs not being actively charged is prohibited. Parking without charging will be reported to the Police department and relevant authorities.
4.2. Compliance with Laws: You must comply with all applicable UAE laws, including the UAE National Electric Vehicles Policy, the Electric Vehicles Charging Infrastructure Regulation for the Emirate of Dubai, and the Regulatory Policy for Electric Vehicle Charging Infrastructure in the Emirate of Abu Dhabi.
4.3. Proper Use of Charging Points: You must use the Charging Points and related equipment according to the instructions provided on or near the station. You must adhere to limitations on the stationing of slow-charging EVs in parking bays equipped with fast-charging equipment.
4.4. Compatibility: You are solely responsible for ensuring that your EV is connected to properly functioning ForEV charging devices compatible with your vehicle.

05 Prohibited Activities

By using the App and Services, you represent and warrant that:

Tamper with, vandalize, or cause damage to ForEV public charging equipment or the surrounding infrastructure.
Attempt to control, restrict, or regulate access to ForEV public charging equipment without authorization.
Use the App or Services for any illegal or unauthorized purpose.
Interfere with, disrupt, or create an undue burden on the App or the networks connected to the App.

06 Customer Obligations and Proper Use

6.1. Charging Tariff: The applicable charging tariff is identified and displayed per Charging Point within the ForEV App before you initiate a session. By starting a session, you accept the applicable tariff for that specific Charging Point. Tariffs are applied in accordance with UAE Cabinet Resolution No. (81) of 2024 and Abu Dhabi Executive Council Decision No. 149/2021 where applicable.
6.2. Pre-Authorization: Pre-Authorization must be updated in accordance with the Network International pre-authorization policy. A Pre-Authorization Amount is required prior to initiating a charging session on the ForEV network. The Pre-Authorization Amount varies from one Charging Point to another, and the specific Pre-Authorization Amount is displayed at the relevant ForEV Charging Point in the ForEV application.
6.3. Payment Processing: All payments are processed by Network International. By initiating a charging session, you authorize ForEV or its third-party payment processor to process your payment method for the full session amount.
6.4. Payment Methods: Accepted payment methods include debit/credit cards and prepaid ForEV wallet balances. You are required to pay the total amount indicated immediately upon receipt. Late payments or failed transactions may result in the suspension of your access to ForEV services until the outstanding balance is settled.

07 Customer Obligations and Proper Use

7.1. Overstay Fee: You must vacate the parking bay promptly after completing charging. Additional overstay fees apply if your EV remains connected to a ForEV charger after charging is complete. These charges will be transparently displayed at the licensed Charging Point. The Overstay fee is non-refundable, and the user is responsible in case they did not read the terms and conditions.
7.2. Improper Use or Damage: Customers causing damage to Charging Points, cables, or other infrastructure due to negligence, misuse, or unauthorized actions will be liable for repair or replacement costs and may incur additional penalties.

08 Cancellation and Refund Policy

8.1. Cancellation: You may disconnect your vehicle and end a session at any time via the ForEV App. However, disconnection or ending a session early does not waive payment for the period the vehicle was connected to the Charging Station.
8.2. Refund Eligibility: Refunds are only applicable in cases of incorrect charges, overpayments, or unresolved technical issues that prevent successful charging on the ForEV network.
8.3. Request Process: Refunds must be requested within three (3) days of the transaction.
8.4. Processing Time and Fees: A refund fee of AED 10 will be applied in case of any approved refund. This fee will be deducted from the refund amount. Any approved refund will be processed within 14 working days from the refund approval and credited to your ForEV mobile account as a prepaid balance.
8.5. Non-Refundable Items: Authorization holds, overstay penalties, and sessions where terms were violated are non-refundable. The Overstay fee is non-refundable, and the user is responsible in case they did not read the terms and conditions.

09 Service Availability and Liability

9.1. Service Availability: ForEV does not guarantee that the Services will be available at all times or that the charging equipment will be free from defects. You acknowledge that ForEV Charging Stations are unsupervised, and you use them at your own risk.
9.2. Limitation of Liability: To the fullest extent permitted by law, ForEV assumes no liability for injuries, damages, losses, or other negative outcomes, except in cases of negligence or willful misconduct. ForEV shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the App or Services. ForEV’s maximum liability for any claim is AED 50,000.
9.3. Indemnity: You are liable for any direct or indirect loss or damage caused by your use of ForEV Charging Stations. You agree to indemnify and hold harmless ForEV from and against any claims, damages, or losses arising from your breach of these Terms and Conditions.

10 Privacy and Data Protection

ForEV collects and handles personal information in compliance with UAE data protection laws. Information is used solely for operational purposes, billing, and improving service delivery. By using our services, you agree to the collection and use of your personal information. Statistical data collected by the Charging Stations is anonymized and not considered personal information.

11 Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the competent courts of the UAE.
